These Terms & Conditions (“Terms”) govern the provision of travel, safari, trekking, accommodation, transportation, cultural, beach and other tourism services arranged or provided by Roaming Skies Travel (“Roaming Skies”, “we”, “us”, or “our”) to the person or persons making a booking (“Client”, “you”, or “your”).

By requesting, accepting, confirming, paying for, or participating in a trip arranged by Roaming Skies Travel, you acknowledge that you have read, understood and accepted these Terms & Conditions.

These Terms should be read together with your quotation, itinerary, invoice, booking confirmation and any special conditions communicated to you in writing. Where a specific written agreement expressly differs from these Terms, that specific agreement shall prevail.

1. ABOUT ROAMING SKIES TRAVEL

Roaming Skies Travel is a Tanzania-based travel and tour company specializing in tailor-made and curated travel experiences, including:
– Wildlife safaris
– Luxury and premium safaris
– Kilimanjaro and mountain trekking
– Cultural and community experiences
– Zanzibar and beach holidays
– Honeymoon journeys
– Day trips and excursions
– Photography and specialist safaris
– Airport transfers and ground transportation
– Accommodation arrangements
– Domestic travel arrangements
– Bespoke and multi-destination itineraries

Depending on the nature of the booking, Roaming Skies may provide certain services directly and may arrange other services through independent third-party suppliers including lodges, hotels, camps, airlines, transport providers, guides, park authorities, activity operators and other tourism service providers.

2. DEFINITIONS

For purposes of these Terms:

“Booking” means an accepted reservation for one or more travel services arranged by Roaming Skies.

“Client” means the person named on the booking and includes all members of the travelling party for whom the booking has been made.

“Lead Traveller” means the person designated as the principal contact for a booking and who accepts responsibility for communicating with the other members of the travelling party.

“Supplier” means any third-party provider whose services form part of an itinerary, including accommodation providers, airlines, transport companies, guides, park authorities, activity operators and other service providers.

“Travel Services” means the services included in a Client’s confirmed itinerary.

“Booking Confirmation” means Roaming Skies’ written confirmation that a booking has been accepted.

“Deposit” means the initial amount required to secure a booking.

“Final Payment” means the outstanding balance payable before travel.

“Arrival Date” means the date on which the Client is scheduled to commence the booked services in Tanzania or another destination covered by the booking.

“Force Majeure” means circumstances beyond the reasonable control of Roaming Skies, as described in these Terms.

3. FORMATION OF A CONTRACT

A booking becomes confirmed only after:
1. Roaming Skies has issued a written quotation or proposal;
2. the Client has accepted the proposed arrangements;
3. the required deposit or payment has been received;
4. Roaming Skies has confirmed the booking in writing.

An enquiry, quotation, itinerary proposal or provisional reservation does not constitute a confirmed booking unless expressly stated otherwise by Roaming Skies in writing.

By making payment against a quotation or invoice, the Client confirms acceptance of these Terms & Conditions.

For group bookings, the Lead Traveller or contracting party confirms that they have authority to make the booking on behalf of all members of the group and that all members agree to these Terms.

4. QUOTATIONS AND PRICES

All quotations are subject to availability and may be subject to change until the booking is confirmed and the required deposit has been received.
Unless expressly stated otherwise, a quotation may include:
– Accommodation
– Meals
– Safari transportation
– Professional guiding
– Park and conservation fees
– Activities specifically listed in the itinerary
– Airport or hotel transfers where specified
– Domestic flights where expressly included
– Other services specifically identified in the quotation

The quotation will specify the inclusions and exclusions applicable to each individual trip.

Prices may change before confirmation because of:
– Changes in accommodation rates
– Government taxes or levies
– Park and conservation fee increases
– Fuel price changes
– Airline fare changes
– Exchange-rate fluctuations
– Supplier price increases
– New or increased government charges
– Changes in requested services
– Changes in group size
– Availability of accommodation or transport

Once a booking has been fully confirmed, Roaming Skies will make reasonable efforts to maintain the confirmed price.

However, government-imposed taxes, statutory fees, park fees, airline charges or other unavoidable supplier increases may be passed on to the Client where applicable.

5. CURRENCY

Unless otherwise stated, quotations for international travellers may be issued in United States Dollars (USD).

Local quotations may be issued in Tanzanian Shillings (TZS).

Where payment is made in a different currency, the Client is responsible for any exchange-rate differences, bank charges, intermediary charges or payment-processing fees unless otherwise agreed in writing.

6. PROVISIONAL BOOKINGS

Where possible, Roaming Skies may place accommodation, flights or other services on provisional hold.

A provisional booking is not guaranteed until the required deposit has been received and the booking has been confirmed in writing.

The period for which a provisional booking can be held depends on availability and the cancellation/payment conditions imposed by the relevant suppliers.

Roaming Skies reserves the right to release provisional reservations when the applicable deadline expires without further obligation to the Client.

7. DEPOSIT AND PAYMENT

Unless otherwise stated on the quotation or invoice, Roaming Skies’ standard payment structure is:
Standard FIT / Private Booking

– 30% deposit upon confirmation of the booking.
– 70% balance payable no later than 45 days before arrival.

Certain bookings may require a different deposit or earlier full payment where required by suppliers.

Examples include:
– Peak-season accommodation
– Luxury camps and lodges
– Special events
– Domestic or international flights
– Kilimanjaro trekking permits
– Zanzibar properties with strict cancellation policies
– Gorilla/chimpanzee or other special permits
– Group bookings
– Special promotional rates
– Non-refundable accommodation
– Last-minute bookings

Where supplier terms require earlier or full payment, those terms will be communicated to the Client where reasonably possible.

Last-Minute Bookings

For bookings made within 45 days of arrival, Roaming Skies may require full payment at the time of confirmation.

For bookings made very close to arrival, full payment may be required immediately in order to secure availability.

8. PAYMENT METHODS

Roaming Skies may accept payment by:
– Bank transfer
– Approved online payment methods
– Credit/debit card where available
– Mobile money
– Cash, where specifically agreed

The Client is responsible for ensuring that Roaming Skies receives the full invoiced amount.

Bank charges, intermediary bank fees, currency conversion fees and payment-processing charges may be payable by the Client unless otherwise agreed.

A booking is not considered paid until the required funds have been received and cleared.

9. LATE PAYMENT

If the Client fails to make payment by the stated deadline, Roaming Skies may:
– Cancel the booking;
– Release accommodation or other reservations;
– Apply supplier cancellation charges;
– Reprice the itinerary based on current availability;
– Require immediate full payment;
– Recover reasonable costs incurred as a result of the late payment.

Roaming Skies shall not be responsible for the loss of availability caused by late payment.

10. CANCELLATION BY THE CLIENT

All cancellations must be submitted in writing by email or another officially accepted written communication channel.

The date on which Roaming Skies receives written cancellation notice will be treated as the effective cancellation date.

Unless the quotation or booking confirmation specifies different supplier-specific cancellation conditions, the following standard cancellation schedule applies:

61 days or more before arrival| Deposit retained
60–31 days before arrival| 50% of total booking value
30 days or less before arrival| 100% of total booking value
No-show / failure to travel| 100%

Cancellation after commencement of trip| 100% of affected services

These percentages represent Roaming Skies’ standard policy and may be superseded by stricter cancellation conditions imposed by individual suppliers.

Where a supplier’s cancellation charge exceeds the standard charge above, the Client will be responsible for the actual non-refundable amount incurred.

11. SUPPLIER-SPECIFIC CANCELLATION CONDITIONS

Some accommodation providers, airlines, camps, lodges, airlines, activity operators and other suppliers operate cancellation policies that are stricter than Roaming Skies’ standard policy.

Where such conditions apply, they will form part of the booking.

Examples may include:
– 100% cancellation charges;
– non-refundable deposits;
– non-refundable flight tickets;
– non-refundable park fees;
– non-refundable permits;
– non-refundable accommodation;
– seasonal cancellation penalties;
– amendment charges.

The Client accepts responsibility for supplier charges that arise from cancellation or amendment of the Client’s booking.

12. REFUNDS

Where a refund is due,

Roaming Skies will process the refund after determining the amount recoverable from relevant suppliers.

Roaming Skies cannot guarantee an immediate refund where funds are being held by a third-party supplier.

Refunds may be reduced by:
– Supplier cancellation fees;
– Bank charges;
– Payment-processing charges;
– Currency conversion differences;
– Non-refundable permits;
– Non-refundable accommodation;
– Airline penalties;
– Park or conservation fees;
– Other non-recoverable costs.

Where a supplier refuses to refund an amount paid on behalf of the Client, Roaming Skies shall not be required to refund that amount unless

Roaming Skies itself has received or is legally required to return those funds.

13. AMENDMENTS BY THE CLIENT

Requests to change a confirmed booking must be submitted in writing.

Amendments may include:
– Change of travel dates;
– Change of accommodation;
– Change of itinerary;
– Change of number of travellers;
– Change of room type;
– Addition or removal of activities;
– Flight changes;
– Changes to transfers.

Amendments are subject to availability and may result in:
– Supplier amendment fees;
– Fare differences;
– Cancellation charges;
– Rebooking fees;
– Additional transportation costs;
– Changes to the total package price.

A reduction in the number of travellers may result in an increased per-person cost for the remaining travellers.

14. CHANGES MADE BY ROAMING SKIES

Roaming Skies reserves the right to modify an itinerary where reasonably necessary due to:
– Weather;
– Road conditions;
– Wildlife movements;
– Park regulations;
– Accommodation availability;
– Safety concerns;
– Flight schedules;
– Government regulations;
– Supplier changes;
– Operational circumstances;
– Force Majeure.

Where reasonably possible, Roaming Skies will provide an alternative service of a similar standard.

If an alternative service costs more because of circumstances outside the Client’s control, Roaming Skies will communicate the additional cost before proceeding where reasonably practicable.

15. ITINERARY FLEXIBILITY

Safari travel is inherently dependent on nature, weather, wildlife, road conditions and local operational conditions.

Wildlife sightings cannot be guaranteed.

Specific animals, migration crossings, weather conditions, photographic opportunities, sunrise/sunset conditions or other natural phenomena cannot be guaranteed.

Published itineraries are intended as an outline of the planned journey and not as a guarantee that every activity will occur at an exact time or in a particular sequence.

16. ACCOMMODATION

Accommodation shown in an itinerary is subject to availability.

Where the specified property is unavailable, Roaming Skies may offer an alternative property of comparable or higher standard.

Room categories, views, bedding configurations and other accommodation preferences are subject to availability.
Special requests such as:
– King beds;
– Twin beds;
– adjoining rooms;
– honeymoon decorations;
– dietary arrangements;
– early check-in;
– late check-out;
– specific room locations;
cannot be guaranteed unless expressly confirmed in writing by the relevant supplier.

17. MEALS AND SPECIAL DIETARY REQUIREMENTS

Clients must notify Roaming Skies of dietary requirements, allergies or food restrictions at the time of booking.

Roaming Skies will communicate such requirements to suppliers but cannot guarantee that every supplier can accommodate every dietary requirement.

The Client remains responsible for informing guides, accommodation providers and relevant staff of serious allergies or medical dietary requirements.

18. FLIGHTS AND AIR TRAVEL

Where flights are included in the itinerary, flights are subject to the terms and conditions of the relevant airline.

Roaming Skies is not responsible for:
– Airline delays;
– Flight cancellations;
– Missed connections;
– Baggage loss;
– Baggage delays;
– Airline schedule changes;
– Overbooking;
– Airline strikes;
– Aircraft changes.

Where Roaming Skies has arranged flights on behalf of the Client, we will make reasonable efforts to assist with rebooking and alternative arrangements.

Any additional costs imposed by the airline may be payable by the Client unless otherwise determined by the applicable supplier or law.

19. BAGGAGE

Clients are responsible for complying with baggage restrictions imposed by airlines, charter companies, safari operators and other transport providers.

Soft-sided luggage is strongly recommended for many safari vehicles and light aircraft.

Where a domestic or charter flight has strict baggage limitations, the Client is responsible for complying with the applicable weight and size restrictions.

Any excess baggage charges are payable by the Client.

20. PASSPORTS, VISAS AND TRAVEL DOCUMENTS

The Client is solely responsible for ensuring that they possess valid:
– Passports;
– Visas;
– Entry permits;
– Transit visas;
– Travel documents;
– Vaccination certificates where legally required;
– Other documents required for entry into Tanzania or any destination included in the itinerary.

Passports should generally have sufficient validity and blank pages as required by the relevant immigration authorities.

Roaming Skies may provide general travel information but does not guarantee the issuance of visas or entry permission.

Immigration authorities have sole authority to determine admission into a country.

If a Client is denied boarding or entry due to inadequate documentation, Roaming Skies shall not be responsible for resulting losses, except to the extent required by applicable law.

21. HEALTH, VACCINATIONS AND MEDICAL REQUIREMENTS

Clients are responsible for obtaining appropriate medical and travel advice before departure.

This may include advice concerning:
– Vaccinations;
– Malaria prevention;
– Altitude;
– Travel medication;
– Existing medical conditions;
– Fitness for trekking;
– Food and water precautions;
– Travel insurance.

Clients must inform Roaming Skies of any medical condition, mobility limitation or special requirement that may materially affect their ability to participate safely in the itinerary.

Roaming Skies reserves the right to refuse participation in an activity where, in its reasonable opinion, participation presents a significant safety risk.

22. KILIMANJARO AND MOUNTAIN TREKKING

Mountain trekking involves inherent risks, including but not limited to:
– Altitude sickness;
– Extreme weather;
– Cold;
– Fatigue;
– Falls;
– Injury;
– Illness;
– Dehydration;
– Delayed rescue;
– Evacuation;
– Changes in mountain conditions.

Participation is voluntary and Clients must disclose relevant health and fitness information to their medical professional.

The Client acknowledges that reaching a summit is not guaranteed.

Mountain guides may require a Client to stop ascending or descend where continuing would present a safety concern.

Where a Client must abandon a climb due to illness, weather, safety or other circumstances, refunds are subject to the cancellation and supplier policies applicable to the booking.

Additional evacuation, medical, accommodation, transportation or other costs may be payable by the Client unless covered by insurance or otherwise accepted by Roaming Skies in writing.

23. SAFARI VEHICLES AND TRANSPORTATION

Safari transportation is subject to road, weather, wildlife and operational conditions.
Safari vehicles may experience mechanical problems despite proper maintenance.

Roaming Skies will make reasonable efforts to provide a suitable replacement vehicle or alternative transportation where required.

Clients must comply with reasonable safety instructions provided by drivers and guides.
Seatbelts must be used whenever provided.

Clients must not:
– Stand or move around a moving vehicle without permission;
– Sit on vehicle roofs or external areas;
– Behave in a manner that endangers themselves or others;
– Disturb wildlife;
– Disobey reasonable safety instructions.

24. WILDLIFE AND SAFETY

Wild animals are unpredictable and potentially dangerous.

Clients must follow all instructions given by guides, park authorities and accommodation staff.

Clients must not approach, feed, touch, chase or otherwise interfere with wildlife.

Roaming Skies shall not be responsible for injury, death, loss or damage resulting from a Client’s failure to follow reasonable safety instructions or from the inherent risks of wildlife encounters, except to the extent that such liability cannot lawfully be excluded.

25. PARKS, CONSERVATION AREAS AND GOVERNMENT AUTHORITIES

National parks, conservation areas and other protected areas are operated under regulations established by the relevant authorities.

Roaming Skies has no control over:
– Park closures;
– Entry restrictions;
– Conservation regulations;
– Wildlife regulations;
– Road closures;
– Ranger instructions;
– Permit availability;
– Government-imposed restrictions.

Clients must comply with all applicable park and conservation regulations.

26. ZANZIBAR AND MARINE ACTIVITIES

Where Zanzibar or marine activities are included, services may be affected by:
– Tides;
– Weather;
– Sea conditions;
– Government restrictions;
– Marine safety regulations;
– Boat availability;
– Operator decisions.

Water-based activities carry inherent risks.

Clients must comply with instructions from boat operators, guides, dive instructors and other activity providers.

27. CULTURAL AND COMMUNITY EXPERIENCES

Roaming Skies is committed to responsible and respectful cultural tourism.

Clients must respect:
– Local customs;
– Religious practices;
– Traditional communities;
– Private property;
– Photography restrictions;
– Local dress expectations;
– Community rules.

Photography or filming of individuals should be undertaken respectfully and, where appropriate, only after permission has been obtained.

28. CHILDREN AND MINORS

Parents or legal guardians are responsible for minors travelling with them.

Certain activities may have minimum age, height, health or safety requirements.

Roaming Skies may refuse participation in an activity where the applicable safety requirements are not met.

29. TRAVEL INSURANCE

Comprehensive travel insurance is strongly recommended and may be mandatory for certain bookings.

Insurance should ideally cover:
– Trip cancellation;
– Trip interruption;
– Medical expenses;
– Emergency evacuation;
– Repatriation;
– Baggage loss;
– Baggage delay;
– Travel delays;
– Missed connections;
– Personal liability;
– Adventure and trekking activities where applicable.

Clients should carefully review their policy to ensure that it covers safari, mountain trekking and other activities included in their itinerary.

Roaming Skies is not an insurance provider and cannot guarantee that an insurance claim will be accepted.

30. PERSONAL BELONGINGS

Clients are responsible for their personal belongings, valuables, passports, cameras, electronics, cash and other property.

Roaming Skies recommends using hotel/lodge safes where available.

Roaming Skies shall not be responsible for loss, theft or damage to personal property except to the extent caused by Roaming Skies’ proven negligence or where liability cannot legally be excluded.

31. PHOTOGRAPHY, FILMING AND DRONES

Clients are welcome to photograph and film their travel experiences subject to applicable laws, park regulations, community permissions and accommodation rules.

The use of drones is subject to Tanzanian aviation, park and other applicable regulations.

Clients must obtain all necessary permissions before operating a drone.

Roaming Skies accepts no responsibility for penalties, confiscation, delays or other consequences arising from unauthorized drone use by a Client.

32. CLIENT CONDUCT

Clients are expected to behave respectfully and responsibly throughout the trip.

Roaming Skies may terminate a Client’s participation without refund where the Client:
– Seriously endangers themselves or others;
– Engages in abusive or threatening behaviour;
– Damages property;
– Engages in unlawful conduct;
– Harasses staff or local communities;
– Is excessively intoxicated;
– Refuses to follow essential safety instructions;
– Seriously disrupts the experience of other travellers.

Any costs arising from such termination, including transportation, accommodation or repatriation, shall be the responsibility of the Client.

33. ALCOHOL, DRUGS AND ILLEGAL ACTIVITIES

Clients must comply with Tanzanian law and all local regulations.

Roaming Skies has zero tolerance for illegal drug use or unlawful conduct during an organised trip.

Alcohol consumption must be responsible and must not compromise safety or the enjoyment of other travellers.

34. THIRD-PARTY SUPPLIERS

Roaming Skies may use independent third-party suppliers.
These may include:
– Hotels;
– Lodges;
– Camps;
– Airlines;
– Charter operators;
– Vehicle providers;
– Boat operators;
– Guides;
– Activity providers;
– Restaurants;
– Local communities;
– Other tourism service providers.

Roaming Skies will exercise reasonable care in selecting reputable suppliers.
However, third-party suppliers operate independently and may have their own terms and conditions.

Where an issue arises with a supplier, Roaming Skies will make reasonable efforts to assist the Client.

35. OUR RESPONSIBILITY

Roaming Skies will use reasonable skill and care in arranging the services included in the confirmed itinerary.

We will make reasonable efforts to:
– Provide the services described in the confirmed itinerary;
– Use reputable suppliers;
– Communicate important changes;
– Assist Clients when reasonable problems arise during travel;
– Provide appropriate alternatives where reasonably possible.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

36. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Roaming Skies shall not be liable for indirect, incidental, special or consequential losses, including:
– Loss of income;
– Loss of business;
– Loss of opportunity;
– Missed onward travel;
– Additional accommodation;
– Additional flights;
– Lost personal property;
– Emotional distress;
– Other consequential expenses.

Roaming Skies shall not be liable for losses caused by circumstances outside our reasonable control or by the acts or omissions of independent third-party suppliers, except where such exclusion is prohibited by applicable law.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by our proven negligence, fraud, wilful misconduct, or any other liability that cannot lawfully be excluded or limited.

37. FORCE MAJEURE

Roaming Skies shall not be considered in breach of these Terms where performance is prevented, delayed or materially affected by circumstances beyond our reasonable control.

Force Majeure may include:
– Natural disasters;
– Severe weather;
– Floods;
– Wildfires;
– Earthquakes;
– Epidemics or pandemics;
– War;
– Terrorism;
– Civil unrest;
– Government restrictions;
– Border closures;
– Strikes;
– Industrial disputes;
– Airport closures;
– Flight disruptions;
– Road closures;
– Park closures;
– Political disturbances;
– Acts of God;
– Major supplier failures;
– Other extraordinary events beyond reasonable control.

Where Force Majeure affects a booking, Roaming Skies will make reasonable efforts to:
1. Notify the Client;
2. Minimize disruption;
3. Offer reasonable alternatives;
4. Recover refundable amounts from suppliers where possible.
Any refund resulting from

Force Majeure will depend upon amounts actually recoverable from suppliers and applicable law.

38. DELAYS AND MISSED CONNECTIONS

Clients are responsible for allowing adequate connection time between independently booked flights, transfers and other travel arrangements.

Where a Client books an international flight separately from a Roaming Skies itinerary, Roaming Skies cannot guarantee that delays to the independently booked flight will not affect the itinerary.

Additional costs arising from missed connections, late arrivals or flight changes may be payable by the Client unless otherwise agreed.

39. LATE ARRIVAL AND NO-SHOW

No refund will normally be provided for:
– Late arrival;
– Missed safari departure;
– Missed transfer;
– No-show;
– Voluntary withdrawal from an itinerary;
– Failure to participate in included activities;
– Early departure.

Any exceptions will be considered according to the circumstances and applicable supplier policies.

40. EARLY DEPARTURE

If a Client voluntarily leaves a trip before its scheduled completion, unused services are generally non-refundable.

This includes, unless otherwise determined:
– Accommodation;
– Meals;
– Safari days;
– Park fees;
– Transportation;
– Activities;
– Flights;
– Permits.

Any additional costs associated with early departure are the Client’s responsibility.

41. SOLO TRAVELLERS AND ROOM OCCUPANCY

Single travellers may be subject to a single supplement where accommodation providers charge additional fees for single occupancy.

Where a member of a group cancels, the remaining travellers may be required to pay an increased per-person rate if the original pricing depended on shared occupancy or minimum group numbers.

42. GROUP BOOKINGS

Group bookings may be subject to separate payment and cancellation conditions.

Roaming Skies reserves the right to establish different:
– Deposits;
– Final payment deadlines;
– Cancellation charges;
– Amendment conditions;
– Minimum group sizes;
for group bookings.

The specific group conditions will be communicated in the relevant proposal or contract.

43. SPECIAL EVENTS AND PEAK SEASONS

Christmas, New Year, Easter, school holidays, migration seasons, major festivals and other peak periods may be subject to stricter supplier policies.

Special-event and peak-season bookings may require:
– Higher deposits;
– Earlier final payment;
– Full payment;
– Non-refundable accommodation;
– Stricter cancellation conditions.

The applicable conditions will be communicated in the booking documentation.

44. SPECIAL REQUESTS

Roaming Skies will communicate reasonable special requests to suppliers.

However, requests are not guaranteed unless expressly confirmed in writing.

Examples include:
– Honeymoon arrangements;
– Birthday celebrations;
– Anniversary arrangements;
– Specific rooms;
– Dietary preferences;
– Bed configurations;
– Early check-in;
– Late check-out;
– Private dining;
– Special activities.

Additional charges may apply.

45. HONEYMOON, ANNIVERSARY AND SPECIAL OCCASION BOOKINGS

Clients should notify Roaming Skies of special occasions before travel.

Where complimentary benefits are offered by suppliers, such benefits are subject to availability and supplier discretion.

Roaming Skies cannot guarantee complimentary upgrades, decorations, cakes, champagne or other benefits unless expressly confirmed.

46. RESPONSIBLE AND SUSTAINABLE TOURISM

Roaming Skies is committed to responsible tourism and encourages Clients to:
– Minimize environmental impact;
– Avoid unnecessary plastic waste;
– Respect wildlife;
– Support local communities;
– Respect cultural traditions;
– Avoid purchasing prohibited wildlife products;
– Follow park conservation regulations;
– Use water and energy responsibly;
– Support locally owned businesses where practical.

Clients must not remove plants, rocks, archaeological objects, wildlife products or other protected materials from national parks or conservation areas.

47. WILDLIFE PRODUCTS AND PROHIBITED ITEMS

The purchase, possession, transportation or export of protected wildlife products may be illegal.

Clients are responsible for complying with Tanzanian and international laws concerning wildlife products and protected species.

Roaming Skies will not knowingly facilitate unlawful wildlife trade.

48. PRIVACY AND PERSONAL INFORMATION

Roaming Skies may collect personal information necessary to arrange and deliver travel services.
This may include:
– Names;
– Passport details;
– Contact information;
– Travel dates;
– Flight information;
– Dietary requirements;
– Emergency contact information;
– Relevant information required for safety or travel arrangements.

Personal information may be shared with relevant suppliers where reasonably necessary to provide the booked services.

Roaming Skies will take reasonable measures to protect Client information and will handle personal data in accordance with applicable law and our privacy practices.

49. MARKETING, PHOTOGRAPHY AND MEDIA

From time to time, Roaming Skies may photograph or film its own travel experiences for marketing purposes.

Where identifiable Clients are intentionally featured in promotional material, Roaming Skies will seek appropriate consent where required.

Clients who do not wish to appear in Roaming Skies promotional content should notify the company in writing.

Nothing in this clause gives Roaming Skies ownership of photographs or videos personally created by the Client unless separately agreed.

50. WEBSITE CONTENT AND IMAGES

Roaming Skies makes reasonable efforts to ensure that information published on its website, social media platforms, brochures and other promotional materials is accurate.
However:
– Accommodation may change;
– Facilities may change;
– Wildlife conditions change;
– Images may represent typical rather than guaranteed experiences;
– Suppliers may alter services;
– Government regulations may change.
Promotional images should therefore be understood as representative rather than a guarantee of exact room, landscape, wildlife or weather conditions.

51. COMPLAINTS DURING TRAVEL

If a Client experiences a problem during the trip, the Client should notify Roaming Skies or the relevant service provider as soon as reasonably possible.

Prompt notification gives Roaming Skies a reasonable opportunity to investigate and correct the problem while the

Client is still travelling.
Complaints raised for the first time after the Client has returned may be more difficult to resolve.

Formal complaints should preferably be submitted in writing within 14 days after completion of the trip.

52. EMERGENCY ASSISTANCE

In the event of an emergency, Roaming Skies will make reasonable efforts to assist with:
– Contacting emergency services;
– Medical facilities;
– Evacuation providers;
– Insurance companies;
– Alternative transportation;
– Family/emergency contacts.

The Client remains responsible for costs associated with emergency services unless those costs are covered by insurance or otherwise accepted by Roaming Skies.

53. CHANGES IN TRAVELLER NUMBERS

Changes in the number of travellers after confirmation may affect:
– Vehicle requirements;
– Accommodation;
– Room rates;
– Guide arrangements;
– Domestic flights;
– Activities;
– Park fees;
– Per-person pricing.

Roaming Skies reserves the right to recalculate the price where the number of travellers changes.

54. TRAVEL WITH ANIMALS

Pets and animals are generally not permitted on safari vehicles, mountain trekking routes, conservation areas or accommodation properties unless expressly approved in advance.

Clients travelling with service animals must inform Roaming Skies before booking.

55. GOVERNMENT TAXES, PARK FEES AND REGULATORY CHARGES

Government authorities may change:
– Park fees;
– Conservation fees;
– Tourism levies;
– Airport charges;
– Taxes;
– Visa fees;
– Permits;
– Other statutory charges.

Where such charges increase after quotation or confirmation and are legally applicable to the Client’s trip, Roaming Skies reserves the right to pass the increase on to the Client.

56. THIRD-PARTY BOOKING CONDITIONS

Where a supplier’s terms are incorporated into the booking, those terms may apply in addition to these Terms & Conditions.
Examples include:
– Airline ticket conditions;
– Lodge cancellation conditions;
– Hotel policies;
– Park authority regulations;
– Mountain authority regulations;
– Boat operator conditions;
– Activity operator conditions.

Where a supplier’s conditions conflict with these Terms in relation to that supplier’s service, the supplier’s specific conditions may prevail to the extent applicable.

57. ASSIGNMENT AND TRANSFER OF BOOKINGS

Bookings may not be transferred to another person without prior written approval from Roaming Skies and the relevant suppliers.

A change of traveller may result in cancellation and rebooking charges.

58. CHILDREN'S AND FAMILY BOOKINGS

Families must comply with accommodation and activity age restrictions.

Certain safari camps, lodges, walking activities, mountain climbs and water activities may impose minimum age requirements.

Roaming Skies will advise Clients of known restrictions where reasonably possible.

59. ACCESSIBILITY AND MOBILITY

Clients with mobility, accessibility or other special requirements should notify Roaming Skies before booking.

Tanzania’s safari and trekking infrastructure varies considerably, and some vehicles, camps, lodges, boats, trails and facilities may not be fully accessible.

Roaming Skies will make reasonable efforts to identify suitable arrangements but cannot guarantee accessibility unless specifically confirmed.

60. RESPONSIBILITY FOR CLIENT INFORMATION

The Client is responsible for providing accurate information when making a booking.
This includes:
– Full legal names;
– Passport details;
– Nationality;
– Date of birth where required;
– Flight details;
– Dietary requirements;
– Medical or mobility requirements relevant to the trip;
– Emergency contact information.

Roaming Skies is not responsible for costs resulting from incorrect information supplied by the Client.

61. INTELLECTUAL PROPERTY

All original Roaming Skies Travel:
– Logos;
– Brand materials;
– Website content;
– Written itineraries;
– Photography;
– Graphics;
– Videos;
– Marketing concepts;
– Travel guides;
– Descriptions;
remain the property of Roaming Skies or their respective owners unless otherwise stated.

They may not be copied, reproduced, commercially distributed or used without prior written permission.

62. WEBSITE USE

Use of the Roaming Skies Travel website is subject to applicable laws and these Terms.
Users must not:
– Attempt unauthorized access;
– Introduce malicious software;
– Copy protected content for commercial use;
– Misrepresent their identity;
– Use the website for unlawful purposes;
– Interfere with website operation.

63. DISPUTE RESOLUTION

Roaming Skies encourages Clients to resolve concerns through direct communication.

Where a dispute arises, the parties should first attempt to resolve it in good faith.

The Client should submit a written description of the dispute and the remedy sought.

Roaming Skies will make reasonable efforts to respond and resolve legitimate complaints.

Where a dispute cannot be resolved amicably, the matter may be referred to the competent courts or other lawful dispute-resolution mechanism in Tanzania.

64. GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania, subject to any mandatory rights or protections applicable to the Client under law.

The competent courts of Tanzania shall have jurisdiction over disputes arising from or relating to a booking, except where applicable law provides otherwise.

65. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force.

66. WAIVER

Failure by Roaming Skies to enforce any provision of these Terms at any time shall not constitute a waiver of the right to enforce that provision in the future.

67. ENTIRE AGREEMENT

These Terms, together with:
– The accepted quotation;
– Booking confirmation;
– Final itinerary;
– Invoice;
– Special conditions;
– Written amendments;
constitute the agreement between Roaming Skies and the Client concerning the booked services.

Any verbal representation that materially changes the agreement must be confirmed in writing by an authorized representative of Roaming Skies.

68. CHANGES TO THESE TERMS

Roaming Skies may update these Terms & Conditions from time to time.

The Terms applicable to a confirmed booking will generally be those provided or made available to the Client at the time of booking, unless a change is required by law or expressly accepted by the Client.

The latest version will be published on the Roaming Skies Travel website.

69. ACCEPTANCE OF TERMS

By paying a deposit, making full payment, confirming a booking, or participating in a Roaming Skies Travel experience, the Client confirms that they:
1. Have read these Terms & Conditions;
2. Understand their contents;
3. Accept the applicable payment and cancellation conditions;
4. Accept the inherent risks associated with safari, trekking and adventure travel;
5. Agree to comply with applicable Tanzanian laws and regulations;
6. Agree to comply with reasonable instructions given by Roaming Skies personnel, guides, drivers and suppliers.

Travel services involve arrangements with multiple independent suppliers, and certain services may be non-refundable once booked.
